Apotex, a firm with an ANDA pending for a generic version of Eisai's Alzheimer's treatment Aricept (donepezil HCl), has sued Eisai in a US district court seeking clarity on the US patent situation so it will not be excluded from entering the US market "when it has a right to do so".
